The elements of the current Article 7

• one party acts in the course of trade or professional activities

• the other (the consumer) does not

• consumer’s ability to sue in home State conditional on:

  • the conclusion of the contract relating to activities that the other party engaged in or directed to that State, in particular soliciting business by means of publicity;
  • the consumer taking the necessary steps to conclude the contract in that State
