Important discussion the past two days on jurisdiction and choice of law
Much creativity being applied to an impt issue needing solutions
In my judgment, success in the effort to develop a coherent international framework will not be sufficient
judicial remedies are not enough--even if fair and convenient
and they will take too long to develop--complex treaties involving multiple issues, all requiring possibly different “solutions”
these are marketing issues as much as legal--want to build trust and confidence NOW--to attract consumers, and forestall imprudent legislative responses too quickly.
